Abstract

The article explores the links between regularisation of migrants in Germany and sham marriages. Situated within an analytical framework of crimmigration studies, it examines how and why the individuals engage in sham marriages in Germany, and what role political activism in support of migrants in an irregular situation plays in this process. Although the individuals who participate in sham marriages in Germany can be liable to punishment in the form of a fine or up to 3 years of imprisonment, there is a phenomenon of “protection marriage” (“schutzehe") aimed at providing undocumented migrants with permanent residential rights. The article concludes by contending that punitive stance of immigration authorities generates new strategies for challenging social exclusion and acquiring membership.
