Abstract

This article analyses how English courts have construed the limits between criticising and defaming people on the internet and what, if any, legal obligations and defences internet users have in reviewing professional services online in the light of the new Defamation Act 2013 (DA 2013). The article will identify the challenges that English law exposes for those who are defamed by online reviews and make recommendations as to how the balance ought to be struck between online freedom of expression and the rights of businesses to protect their commercial reputations.
